Yellow Madhouse is an independent creative business producing and publishing original fiction, fantasy world-building, tabletop role-playing game materials, books, illustrations, artwork and associated merchandise.

Our creative work includes, among other things, the fictional setting of Rodozem and the tabletop role-playing adventure The Devil’s Bridge, together with their associated stories, lore, characters, locations, illustrations and other original materials.

This Notice applies to the content and materials made available through our website and other official channels, except where separate terms or licences expressly apply.

2. Ownership and Protection of Intellectual Property

Unless expressly identified otherwise, original creative materials published by Yellow Madhouse are owned by Yellow Madhouse or used by us under appropriate permission or licence.

Our intellectual property includes, without limitation:

• Original literary works, books, adventures, narratives, dialogue and written descriptions.
• The Rodozem setting and its original world-building, including fictional histories, characters, creatures, locations, cultures, maps, relationships and associated lore.
• Original artwork, illustrations, graphic designs, maps, visual assets and other artistic works.
• Original names, logos, branding, titles, designs and other identifying materials, to the extent protected by applicable law.
• Original editorial, creative and design arrangements and the selection and presentation of our materials.
• Other original creative works developed, commissioned or published by us, subject to applicable ownership agreements and third-party rights.

These materials may be protected by copyright, trade mark rights, design rights and other applicable intellectual property laws.

The fact that a work is published online, offered for free, distributed as a promotional item or made available for personal enjoyment does not, by itself, place it in the public domain or grant unrestricted permission to reproduce or exploit it.

Nothing in this Notice transfers ownership of our intellectual property to a visitor, customer or third party.

3. Restrictions on Unauthorised Use

Unless expressly permitted by law, an applicable licence or our prior written authorisation, you must not:

1. Reproduce, copy, republish, distribute, sell, sublicense or otherwise exploit our protected creative materials.

The fact that material is publicly accessible, downloadable or available without charge does not constitute a general licence to reproduce, adapt or commercially exploit it.

4. Our Creative Independence and Artificial Intelligence Policy

Yellow Madhouse does not use generative artificial intelligence to create, generate or develop creative work as part of our creative process. Our creative process is undertaken by people.

This policy reflects our commitment to human creativity, authorship and the integrity of the worlds, stories and artistic materials we develop and publish.

We do not authorise the use of our protected creative materials to train, fine-tune, test or develop generative AI models or systems, or to generate AI outputs based on those materials, unless we have expressly agreed otherwise in writing or the relevant use is permitted by applicable law.

Without the necessary authorisation, we do not permit our protected materials to be:

• Collected or reproduced for the purpose of creating or expanding AI training datasets.
• Used to train, fine-tune or improve generative AI models.
• Incorporated into AI systems or datasets for the purpose of generating competing or derivative creative content.
• Submitted to generative AI tools for the purpose of reproducing, imitating or adapting our protected stories, characters, artwork, illustrations, maps or other original creative materials.
• Reproduced or transformed by automated systems in ways that infringe our intellectual property rights.

This policy applies to the use of our protected materials by individuals, businesses, developers, automated systems and other organisations, subject to applicable law.

Nothing in this section asserts ownership over AI technology itself, extends our rights beyond those provided by law, or excludes uses that are legally permitted without our authorisation.

5. Fan Creations and Community Participation

We appreciate the enthusiasm, imagination and creativity of the communities that engage with our work.

Unless we publish specific fan-content guidelines or grant a separate licence, engagement with our fictional settings does not automatically grant permission to reproduce or commercially exploit our protected intellectual property.

Any fan creation incorporating our protected materials remains subject to applicable intellectual property law. Whether a particular use requires permission depends on the nature of the material used, the manner of use and the applicable law.

Unless expressly authorised in writing, we do not grant a general licence to create or commercially distribute derivative books, adventures, settings, artwork, merchandise or other products based on our protected intellectual property.

We may publish additional guidelines or grant specific permissions for fan projects, community activities or other uses at our discretion, subject to the terms of the relevant permission.

6. Customer Purchases and Product Licences

Purchasing a book, downloadable publication, artwork or other product from Yellow Madhouse does not transfer ownership of the underlying intellectual property.

Unless the relevant product terms or a separate written licence expressly provide otherwise, a purchase grants only the rights necessary to use the purchased item for its intended personal purpose.

In particular, purchasing a product does not automatically grant permission to:

• Reproduce or redistribute the product or its contents.
• Share paid digital files publicly or make them available for unauthorised download.
• Reprint, republish, translate, adapt or create commercial derivative works from the contents.
• Use protected artwork, maps, text or other materials in merchandise or other products for sale.
• Use the purchased materials to train generative AI models or create unauthorised AI-generated adaptations.

Any additional permissions, restrictions or licence terms supplied with a product shall apply to that product.

Nothing in this section removes any rights that customers have under applicable consumer law or any express licence granted by us.

7. Third-Party Rights and Attributions

Certain materials appearing on our website or in our publications may be owned by third parties, licensed to us or used with permission.

Those materials remain subject to the rights and terms applicable to their respective owners. Their inclusion in a Yellow Madhouse publication does not mean that we own them or can grant permissions beyond those available to us.

Where relevant, applicable credits, attributions and licence conditions should be respected.

Nothing in this Notice grants permission to use third-party intellectual property.

We make reasonable efforts to ensure that the information on our website and our product descriptions are accurate and appropriately presented.
